Purpose of this policy:

PFA Solutions, and its affiliates (“PFA Solutions,” “we,” “us,” or “our”) are committed to respecting and protecting personal information collected through our website (www.pfasolutions.com) (the “Site”), and/or services provided through the FirmView platform (collectively the “Platform”). Our privacy policy (“Privacy Policy”), the Terms of Use, and, as applicable, the Master Services Agreement between us and your employer comprise the entire agreement governing access to and use of the Site and Platform (collectively, the “Agreement”). By visiting our Site or using the Platform, you agree to the Agreement. If your employer entered into an MSA with us, then you represent that you are an authorized user of the Site and the Platform, and will abide by the terms of the Agreement. Capitalized terms not defined in this policy shall have the meaning set forth in our Terms of Use.

Scope of this policy:

The Site and the Platform are operated by PFA Solutions in the United States (US), and complies with US law. If you are located outside of the US, please be aware that any information you provide to us may be transferred to, processed, maintained, and used on computers, servers, and systems located outside of your home country, where the data protection laws may not be as protective as those in your jurisdiction.

What Information We Collect & the Purpose of Collection and Use:

Contact Information.

We collect contact information on our Site from visitors and customers that sign-up to receive our newsletter, contact us via the Contact Us page on our Site, submit a request to schedule a demonstration of our Platform, or would like to download a whitepaper. Contact information is provided via browser forms or online order forms, and may include first name, last name, e-mail address, job title, name of the organization, country, state/region and phone numbers (fax, cell and/or landline), technical requirements, and other information necessary for us to properly respond. This contact information is used by our sales, support and Platform teams to contact our Site visitors and customers, as appropriate, so that we can provide the requested information, support, or services.

Account Information.

When you create an account (on your own behalf or on behalf of your employer), we collect your name, title, company name, and contact information. We use your account information to process and transmit necessary data regarding your account, orders, payments and general updates.

Billing Information.

We collect billing and payment information which may include a purchase order number, an account number, or instructions for wire transfers and/or ACH transfers. We may accept payment by credit card in our sole discretion, and use third party credit card processors for such purpose. The billing and payment is used to prepare and send invoices, make and receive payments, and manage accounts.

Platform Data.

We process personal data within the Platform to provide the services to our customers. Platform Data may include the personal data of customer’s authorized users, and contacts, deal information, attachments, and general notes inputted by the customers and their authorized users into the Platform.

Job Applicant Information.

We collect resumes and other information relevant to applying for positions at PFA Solutions such as name, email address, phone number and resume (“Job Applicant Information”). We use Job Applicant Information to determine your eligibility for the position, and contact you in connection with your application.

Other Data & Additional Uses

Google Analytics.

Like most organizations, we rely on automatic data collection technology (Google Analytics) when you visit our Site or use the Platform. Google Analytics may use tracking technologies such as but not limited to cookies to collect information on our behalf such as your IP address, Internet service provider, browser type, operating system and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Site you visit, number of links you click while on the Site, search terms, and other data. By accessing and using the Site, you consent to the processing of data about you by Google Analytics in the manner and for the purposes set out in this policy. For more information on Google Analytics, including how to opt out from certain data collection, please visit https://www.google.com/analytics. Please be advised that if you opt out of any service, you may not be able to use the full functionality of the Site and/or the Platform.

Cookies.

Cookies are small packets of data that a Site stores on your computer’s hard drive so that your computer will “remember” information about your visits to our Site and other sites as described under “Google Analytics,” above. If you do not want us, Google Analytics or the Site to place a cookie on your hard drive, you may be able to turn that feature off on your device. Please consult your Internet browser’s documentation for information on how to do this, such as by using your browser in private mode to block cookies. However, if you decide not to accept cookies from our Site, the Site and/or the Platform may not function properly.

Aggregate Data.

In an ongoing effort to better understand our customers, the Platform and the Site, we might analyze your information in an anonymized, aggregated form to operate, maintain, manage, and improve the Site. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our Platform and the Site to current and prospective business partners and to other third parties for other lawful purposes.

 

Additional Uses.

We also use Contact Information, Billing Information and other information collected pursuant to this policy to respond to general inquiries, solicit feedback regarding our Platform and support, provide relevant content on our Site including advertisements regarding Platform, and to communicate with you via email regarding our current and future services.

Sharing Your Information

Service Providers.

Like many businesses, we engage other companies and individuals to perform certain business-related services. We may disclose personal information to these third parties, but only to the extent needed to enable them to provide such services. Examples include technical assistance, order fulfillment, customer service, and marketing assistance. Our contracts require that these third parties provide at least the same level of data protection as set forth in this policy. We may also disclose personal information to our affiliates in order to support marketing, sale and delivery of services.

Business Transfers.

In the event of a merger, dissolution, reorganization or similar corporate event, or the sale of all or substantially all of our assets, we expect that the information that we have collected, including personal information, would be transferred to the surviving entity in a merger or the acquiring entity. All such transfers shall be subject to our commitments with respect to the privacy and confidentiality of such personal information as set forth in this policy. This policy shall be binding upon PFA Solutions and its legal successors in interest.

Disclosure to Public Authorities.

We are required to disclose personal information in response to lawful requests by public authorities, including for the purpose of meeting national security or law enforcement requirements. We may also disclose personal information to other third parties when compelled to do so by government authorities or required by law or regulation including, but not limited to, in response to court orders and subpoenas.

Opt-Out for Direct Marketing; Email Management.

You may opt-out at any time from the use of your personal information for direct marketing purposes, and/or the transfer of your personal information to third parties for direct marketing purposes by contacting info@pfasolutions.com Please allow us a reasonable time to process your request.

You may also manage your receipt of marketing and non-transactional communications by clicking on the “Manage Email Preferences” link located on the bottom of any PFA Solutions marketing email and following the instructions found on the page to which the link takes you. You cannot opt out of receiving transactional e-mails related to your account or use of the Platform.

Access, Retention and Protection of Personal Information:

Correction of Personal Information.

You have the right to correct, amend or delete your personal information where it is inaccurate or has been processed in violation of this policy by sending a notice to us at info@pfasolutions.com with “Privacy Policy” in the subject line. Please allow us a reasonable time to respond to your request.

Retention of personal information.

We will retain your personal information in a form that identifies you only for as long as it serves the purpose(s) for which it was initially collected as stated in this policy, subsequently authorized, or permitted by applicable law. After such time periods have expired, we may either delete your personal information or retain it in a form such that it does not identify you personally.

Protection of personal information.

PFA Solutions takes very seriously the security and privacy of the personal information that it collects pursuant to this policy. Accordingly, we will implement reasonable and appropriate security measures to protect your personal information from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the risks involved in processing and the nature of such data, and comply with applicable laws and regulations.

Additional Terms:

External Sites.

The Site may contain links to sites that are not owned or operated by PFA Solutions (“External Sites”). PFA Solutions has no control over the privacy practices or the content of these External Sites, and therefore is not responsible for them or the products/services they offer and/or advertise. You should check the applicable third-party privacy policy and terms of use when visiting any External Sites.

Children.

We do not knowingly collect personal information from children under the age of 13 through the Site or the Platform. If you are under 13, please do not give us any personal information. We encourage parents and legal guardians to monitor their children’s Internet usage and to help enforce our policy by instructing their children never to provide personal information through the Site or the Platform without their permission. If you have reason to believe that a child under the age of 13 has provided personal information to us, please contact us, and we will endeavor to delete that information from our databases.

California Residents.

California residents who have an established business relationship with PFA Solutions may choose to opt out of our sharing their personal information with third parties for direct marketing purposes (CA. Civil Code §1798.83). If you are a California resident and you wish to opt out; or request certain information regarding our disclosure of your personal information to third parties for direct marketing purposes, please send an email to info@pfasolutions.com with “Privacy Policy” in the subject line or write to us at the address set forth below. PFA Solutions does not monitor, recognize, or honor any opt-out or do not track mechanisms, including general web browser “Do Not Track” settings and/or signals.

Changes to this policy:

This policy is effective as of the date stated at the top of this policy. We may change this policy from time to time with or without notice to you. Any such changes will be posted on the Site. By accessing the Site after we make any such changes to this policy, you are deemed to have accepted such changes.
